Hi,

I want to bring to your attention an important matter that is affecting A2 (Romanians and Bulgarians) nationals who are interested in doing work based study courses in UK.


Bulgarians and Romanians (A2 Nationals) are allowed to come to UK without the need for a visa and can also get admission into training institutes in UK for conventional study courses (where students attend classes). However they cannot get admission into work based courses (NVQ courses which are assessed by approved NVQ assessor at students work place) because they need a registration certificate from the Home Office before they can start work legally for a UK employer. It is a catch 22 situation at the moment due to the existing Home Office rules if they are followed properly.

The Home office guidance states that "Please be advised that while you can apply for a registration certificate confirming your rights as a student at any time, the document will not be issued until you have begun your course of study."

Training institutions can only enroll those students on work based courses who are already working legally in their field. So this effectively denies A2 nationals to get admission into a work based course to improve their skill and qualification levels. The training institute will not be able to enroll them and therefore they can never start their course of study and the Home Office will not issue them with the required registration certificate before they have begun their course of study.

The Home Office should change the rule so that Bulgarians and Romanians who wish to take admission into work based courses can do so legally. The Learning and Skills Council (LSC) provides funding to the A2 nationals for all conventional and work based courses as they are EEA nationals; but the Home Office existing rules effectively denies them this opportunity.


I have submitted a petition to the Prime Minister for this rule to be changed; this can be viewed and signed by all UK residents (anyone living in UK, does not have to be British Citizen) at the following link:
