Well, if you look at the latest of their online thing you'll notice that there are two articles in there which already appeared in Quest Bulgaria magazine - one in April and the other in May.... strange, eh?

QuestBulgaria
01-06-06, 10:20 AM
Given that one of the articles in question is an interview which we undertook directly and was written by us, don't you think it is more than a bit of a cheek to reprint it without the copyright holders permission? In addition adding to your heading "this month we talk to...." as if it were your own work!

QuestBulgaria
01-06-06, 01:35 PM
I am not talking about advertising. I am talking about an interview which I myself conducted and is therefore our copyright, which you have published in your online mag without asking for permission or checking whether the person who sent it to you had copyright to it. As publishers for over 25 years we always check whether the person sending information to us owns the copyright. I am glad you will remove the said article of ours and I think this states quite clearly that you know you are in breach of copyright.

Best wishes
Quest Bulgaria

What we are saying is, by publishing "this month we spoke to..." is blatantly making out that this work is your own when in fact you haven't posed any questions to the person. We don't have a problem with our work being 'shared' as long as we are asked in advance and are given the correct credit. We do have a problem when people just take it and present it falsely as their own.

As we have been in publishing for more than 25 years, we'll share some information with you as you've only been at this for two months, to put you on the right track :

- it is the responsibility of the publisher (i.e., you) to check that all contributions, be they articles or photographs, have not been used elsewhere on an exclusive nor are there any copyright restraints
- taking somebody else's work and publishing it as if it were your own is not only unethical but it is illegal
- taking images from the internet or scanning in road maps or other printed material without the express prior written permission of the owners of those works is also illegal

Any breaches of the above can be prosecuted in the legal system. We very kindly gave you the opportunity to put right your breach of copyright as we know you are a novice to this. However, other publishers or owners of copyrighted material might not be so kind. Breach of copyright is a very serious offence.

Hope all this helps a bit

Hi Debbie, don,t worry too much about 'QuestBulgaria' they have upset more people on other forums, and been banned for doing so, than you would believe. Just keep up the good job you are doing and I am sure Jaine and Co will survive by fair means or foul as always.

Dear Quest BG,

As I am connected with the advertiser you are talking about, I have been in contact him about this situation. The interview, which you state you have conducted personally, has been written by himself and there has never been such a thing as a personal interview. You even did not publish the whole interview, but adjusted it to your taste without notifying the advertiser. You helped with setting up some questions, that's all! Therefore there is no such a thing as copyright. Furthermore If you are a professional company you don't fight a personal war on a public site, but you contact the persons involved directly to solve this issue. You really should think about your actions as this will also affect your own business in a very negative way, as you can see on the comments other people made. I want to make clear that I am not an employee of the advertiser and I don't have anything to gain or loose. My message to you: stay professional and become friendly.

QuestBulgaria
02-06-06, 06:39 PM
I think we have been friendly by allowing the online mag to put right their error and not resorting to legal action instantly. Indeed our lawyers wanted to act straight away but we held them off to give them a chance. Clearly they are totally unaware of copyright issues as they are new to all this. By putting our expertise on here we also feel we are being friendly as this will help them to understand some of the issues involved in publishing, after all we've been doing this over 25 years.

Publishing someone else's work as your own is not only unethical but also illegal.

We didn't "just help" setting up questions but had lengthy correspondence and numerous phone calls with the gentleman. We spent days on this. So, as far as we are concerned for someone to say they did the interview and publish our work is not at all professional and totally unfair; certainly not friendly.

Of course one does not publish an entire interview, if one did this, most interviews would become just advertising and that is not what editorial is about. Editorial is the expression of the publication concerned and is their copyright.

At the end of the day, someone has published our article as if it were their own work and that is strictly illegal.

How would anyone like it if they took a great deal of time to create something which no one else has done only to find it bandied around for free by somebody who decided to use it because it was good and looked good for them.

It also seems strange that you suddenly just joined this forum and your first post is :
"Do you already know about xxx
On this portal you can find properties for sale AND rental AND hotels too.
Cheers,
Angel"

and your second post is in this thread. Odd eh ?

Angel

I read the mag cover to cover -- wish you all the best with future items . l even managed to complete the crossword -- do l get a prize ? lmao - just teasing my bulgarian is bad and if it was not for people like Suzanne l would
not have any romantic utterings to say to mi saprooga -- the language books dont realy go into that side of things. Im not so sure what item Quest Bulgaria are talking about but its a good publication too -- and l freely admit that ive done a little plagerizing in my time . Maybe next months issue you can give them a credit mention and settle the differences without them attacking one so young on a public forum -- keep up the grand work and good luck -- Alsie http://shenkova-gray-kardjali.wetpaint.com

QuestBulgaria
02-10-06, 06:48 PM
Yes, Alsie, it would be nice if one so young and inexperienced could admit that they have plagerised our material (plagerisation is absolutely illegal by the way, but everyone on the internet does it, Debbie most seriously included).

We would be happy to work with them, and yes we are a very very good publication (thanks for that) with serious helpful content - they maybe could benefit from our serious experience in publishing?

I doubt that they would give us a credit mention, even though they have stolen our material and continue to do so.... but it would be very nice if they did. Age has nothing to do with it. Debbie came to give us a hand and stuck stamps on enveloped for a few days, tried to write an article for us which was given by someone else, and the second she did was stolen outright from the internet, which we could not publish given copyright laws.

Thanks for your balanced opinion.

All the best, Jain

02-10-06, 08:29 PM
OOPs may I apologize Jain ? l will take the proverbial foot out my mouth and bow out your debate as gracefully as l can -- in my defence l will say l had no idea there was so much history between yourselves and the said young Debbie. Being a mere humble Scotsman desperate to get as much Bulgarian knowledge as l can crammed into the ``napper`` l sometimes reach out in desperation lol. I particulary like your articles on Bulgarian cuisine(saprooga only taught me one dish) and do give your publication a big thumbs up! l would love to see an article on just Scottish flights to Bulgaria maybe thats a a bit biased of me but l make no apology on this one because most publications concentrate on London or Manchester flights. Ok Scotland only has a population same size as Bulgaria but every flight l have been on has been full so there is obviously a big Scottish market out there too.Maybe im being to self serving for your ace publication. But a days trek to London to take advantage of wizz air fares makes it as expensive as flying from Edinburgh or Glasgow. thanks ---- alsie http://shenkova-gray-kardjali.wetpaint.com

Dear Everyone who reads these forums,

On behalf of Bulgaria Info online, I will say this once yet again. We will not enter into slagging off matches online and anyone who is professional would not do so either. Every publication has its own merits and we have stolen nothing from anyone,,,anything supplied to us was done so by unsuspecting innocent people who did not realise they were breaking any copyright,,,even when asked! and that one said article (in June issue) was taken off line by ourselves as the person in question was upset by an outright unprofessional attack by another publication, they did not realise that providing information to us about themselves would cause world war on the forums! We believe that the said person apologised to Quest Bulgaria for this , so that should be the end of it.

To clear up Debbies articles,,,she researched articles for you on the internet but did not steal anything and I believe you published at least 4 out of the 5 that she wrote for you including caving, baba marta and focus on Ski resorts. I believe that you also published her Health Insurance article so I believe that maybe credit should have been shown for the hard dedicated work that she put into these articles for your readers (however you omitted to mention her name as the author, so perhaps you should credit her?)

It is a shame that so called friendship can turn so sour when it suits the other party. We are willing to forgive all your nasty comments and would love to accept an article from yourselves for our Novemeber publication, so that all peace can be restored. We could even meet up at the French Restaurant to discuss it, I believe it's your turn to treat us, and John has always wanted to meet you both, he was so sorry that he missed the Indian. We will also happily supply you with an article for you magazine too. Lets all work together as we always wanted to do as lets face it we all want to help promote this beautiful country and give people information!

WOW !!! Debbie is from Jocksville. l have flown with czeh airlines from Edinburgh with a 1 hour stop over in Prague on way out and 5 hours on way back. I will be coming over 20th December but this time l think with Luftthansa Airlines who seem to have taken over Czeh airlines winter schedule from Edinburgh. So this means a 1hour stopover in Munich outward and 5 hour on the return .

PRice driven as us canny Scots are im trying to find out if it is legal to buy 2 return tickets and fly out with an empty seat - ensuring my wife is booked on same flight on my return to Scotland in January.

Any help anyone can give me on this one will be greatly appreciated .

as you know the closer to departure date prices rise and one way ticket for here would cost an arm and leg !

Anyone out there in forum land help me on this one . visit our web site http://shenkova-gray-kardjali.wetpaint.com

From Jocksville or Fredsville or.... please be careful with regard to inheritance law. We have had several dozen readers email us on this question, all of whom have been answered by a practicing up to date Bulgarian lawyer who has worked in the UK. Please remember, that Bulgarian inheritance law follows normal European practice - diametrically opposed to UK law - so if you live here or have bought through a company you need advice!
